Kaelvi is an online store operated from Quebec, Canada ("Kaelvi," "we," "us," or "our"). We operate this website, store, and related products and services (the "Services"). Our store is powered by Shopify, which enables us to provide the Services.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit or use the Services, make a purchase, or communicate with us. If this Privacy Policy conflicts with our Terms of Service regarding personal information, this Privacy Policy controls.

Personal Information We Collect

Personal information is information that identifies you or can reasonably be linked to you. Depending on how you interact with us and where you live, we may collect:

  • Contact and identity information, such as your name, email address, telephone number, billing address, and shipping address.
  • Order and transaction information, such as products viewed or purchased, cart activity, order history, returns, warranty or Shipping Protection claims, payment confirmation, and transaction details.
  • Payment information, such as payment method and billing details. Complete payment-card information is generally processed by Shopify or our payment providers rather than stored directly by us.
  • Account information, such as login credentials, saved preferences, and account settings.
  • Communications and submissions, such as support messages, survey responses, reviews, photographs, videos, claim evidence, and other information you send us.
  • Device and usage information, such as IP address, browser and device type, identifiers, referring pages, pages viewed, interactions, approximate location derived from IP address, and cookie or similar technology data.
  • Marketing and preference information, such as communication preferences, ad interactions, and inferences about products that may interest you.

We do not seek to collect sensitive medical information. If you voluntarily include health information in a support or product-safety inquiry, we will use it only as reasonably necessary to respond, protect safety, comply with law, or establish or defend legal rights.

How We Collect Personal Information

We collect personal information:

  • Directly from you when you browse, place an order, create an account, subscribe, submit a review, make a claim, or contact us;
  • Automatically through cookies, pixels, local storage, logs, and similar technologies;
  • From Shopify and service providers that support payments, fraud prevention, analytics, marketing, customer service, fulfilment, and delivery; and
  • From advertising, social media, referral, and business partners where permitted by law.

How We Use Personal Information

We may use personal information to:

  • Provide the Services, process payment, fulfil and deliver orders, manage accounts, and provide order updates;
  • Handle returns, refunds, product support, safety inquiries, warranty claims, and Shipping Protection claims;
  • Personalize and improve our store, products, advertising, and customer experience;
  • Send transactional communications and, with any consent required by law, marketing messages;
  • Measure advertising, understand usage, and prevent repetitive or irrelevant advertising;
  • Detect, investigate, and prevent fraud, abuse, security incidents, illegal activity, and violations of our policies;
  • Comply with legal obligations, respond to lawful requests, enforce agreements, and establish, exercise, or defend legal claims; and
  • Carry out a merger, financing, sale, reorganization, or other business transaction, subject to applicable safeguards.

Where applicable law requires a legal basis, we rely on performance of a contract, compliance with legal obligations, our legitimate interests, and consent, as appropriate. You may withdraw consent where consent is the basis, subject to legal and contractual restrictions and reasonable notice.

Cookies and Similar Technologies

We and our providers use cookies and similar technologies to operate the store, remember preferences, maintain security, measure performance, understand usage, and support advertising. Some technologies are necessary for the Services to function. Others may be controlled through our cookie banner or browser settings where available.

Blocking cookies may affect functionality. For information about cookies used by Shopify, visit Shopify's Cookie Policy.

How We Disclose Personal Information

We may disclose personal information to:

  • Shopify, which hosts the store and processes information to provide and improve Shopify services;
  • Service providers for payment processing, fraud prevention, IT, hosting, analytics, customer support, communications, marketing, fulfilment, shipping, warranty administration, and professional advice;
  • Advertising and business partners to measure or provide advertising and related services, subject to applicable consent and opt-out rights;
  • Authorities and other parties when reasonably necessary to comply with law, lawful process, or safety obligations, or to protect rights, security, and property; and
  • Transaction parties in connection with an actual or proposed merger, financing, sale, insolvency, or transfer of all or part of the business.

We do not disclose personal information to third parties for their own unrelated purposes without consent unless permitted or required by law. Some U.S. privacy laws may define certain advertising-related disclosures as "sale," "sharing," or targeted advertising even when no money is exchanged.

Targeted Advertising and U.S. Privacy Choices

Depending on where you live, you may have the right to opt out of sale, sharing, or use of personal information for targeted advertising. You may submit an opt-out request through our data-sharing opt-out page. Where required, we also process a recognized Global Privacy Control signal as an opt-out request for the browser or device sending it.

We do not knowingly sell or share for targeted advertising the personal information of individuals under 16 years of age.

Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy, including to provide the Services, maintain business and tax records, honour warranties, resolve disputes, prevent fraud, and comply with law. Retention periods vary according to the type of information, the relationship, legal requirements, and whether the information is needed to establish or defend a claim. When information is no longer required, we delete, destroy, or anonymize it in accordance with applicable law.

Security and Privacy Incidents

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. No system is completely secure, and we cannot guarantee absolute security. If a privacy incident occurs, we will assess it, take reasonable steps to reduce harm, keep required records, and notify affected individuals and regulators when required by law.
