These Terms of Service govern your access to and use of Kaelvi's website, store, content, products, and related services (collectively, the "Services"). Kaelvi is an online store operated from Quebec, Canada. Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

By visiting the website, creating an account, or purchasing from us, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Services. Any rights that cannot lawfully be waived remain in effect.

1. Eligibility and Accounts

You must be at least the age of majority where you live, or use the Services with the involvement and permission of a parent or legal guardian. You are responsible for providing accurate information, maintaining the confidentiality of your account credentials, and all activity reasonably attributable to your account. Notify us promptly of suspected unauthorized use.

2. Products and General Wellness Use

Kaelvi products are intended for personal, household, and general wellness use. They are not intended to diagnose, treat, cure, mitigate, or prevent a disease or medical condition and are not a substitute for professional medical care. You must review and follow the instructions, warnings, contraindications, and safety information supplied with the product and in our Product Safety Disclaimer.

We try to display products, colours, dimensions, features, and packaging accurately. Screens and manufacturing updates may produce minor differences that do not materially affect function. We may update product designs or packaging without notice, provided the product remains materially consistent with its description.

3. Orders

Your order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, payment or fraud concerns, suspected resale, legal restrictions, or inability to deliver. If we cancel an order after payment, we will refund the cancelled amount.

You agree that the contact, billing, payment, and shipping information you provide is current, complete, and accurate. We may contact you to verify an order. Products are for personal use unless we agree otherwise in writing.

4. Prices, Payment, and Taxes

Prices and promotions may change without notice before an order is placed. The amount charged is the amount shown at checkout, subject to correction of an obvious error. Prices may be displayed or settled in different currencies depending on location and payment provider. You authorize us and our payment providers to charge the payment method you submit for the order total and any amounts clearly accepted at checkout.

Taxes, shipping charges, duties, and other applicable charges are shown at checkout where we collect them. You remain responsible for import charges not collected by us.

5. Shipping, Returns, Optional Protection, and Warranty

Our Shipping Policy and Return, Refund, and Warranty Policy are incorporated into these Terms. They explain processing and delivery estimates, the 90-Night Risk-Free Guarantee, optional Shipping Protection, the optional Two-Year Extended Warranty, defects, replacements, returns, and refunds.

The optional Two-Year Extended Warranty provides the replacement remedy stated in that policy and is additional to mandatory legal warranties. Optional Shipping Protection provides an additional replacement remedy for qualifying package loss or theft. Neither optional service restricts rights that cannot be excluded by law.

6. Promotions, Reviews, and User Content

Promotions are subject to their stated conditions and may be changed or withdrawn before an order is placed. Unless stated otherwise, discounts cannot be combined, have no cash value, and do not apply retroactively.

If you submit a review, image, feedback, or other content, you confirm that you have the right to submit it and that it is truthful, lawful, and does not violate another person's rights. You grant Kaelvi a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for formatting, publish, translate, and display that content in connection with our business and marketing. We may moderate or remove content, but are not required to do so. We will not attribute statements to you that materially change their meaning.

7. Intellectual Property

The Services, including their text, graphics, logos, photographs, videos, design, software, and arrangement, are owned by or licensed to Kaelvi and are protected by applicable intellectual property laws. You may use the Services only for personal, non-commercial shopping and information purposes. You may not copy, scrape, reproduce, distribute, sell, reverse engineer, or exploit any part of the Services without written permission, except as allowed by law.

8. Acceptable Use

You may not use the Services to violate law or another person's rights, transmit malicious code, interfere with security or operation, collect information about others without authorization, submit false information, engage in fraud, or attempt unauthorized access. We may suspend or terminate access for a material violation.

9. Third-Party Services and Links

The Services may use or link to third-party services, including Shopify, payment providers, carriers, analytics providers, and social platforms. Their services may be governed by separate terms and privacy notices. We are not responsible for independent third-party websites or services that we do not control, although this does not remove any responsibility imposed on us by law.

10. Privacy and Electronic Communications

Our Privacy Policy explains how we collect, use, and disclose personal information. By placing an order, you agree to receive transactional electronic communications relating to that order. Marketing messages are sent only as permitted by law, and you may unsubscribe using the method provided in the message.

11. Disclaimers

To the maximum extent permitted by law, the website and its general informational content are provided on an "as available" basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free. Product warranties and remedies are limited to those expressly provided in our policies and those imposed by law.

We do not exclude any implied warranty, legal warranty, consumer guarantee, or other right that cannot lawfully be excluded. In particular, Quebec consumers may benefit from legal warranties including normal use, reasonable durability, and freedom from hidden defects.

12. Limitation of Liability

To the maximum extent permitted by law, Kaelvi and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss, or for lost profit, revenue, data, or opportunity, arising from the Services or products. For claims that may lawfully be limited, our aggregate liability will not exceed the amount paid for the product or order giving rise to the claim.

These limits do not apply to fraud, wilful misconduct, gross negligence, personal injury caused by our fault where liability cannot be limited, or any other liability that applicable law prohibits us from limiting. Some jurisdictions do not permit certain exclusions, so portions of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to indemnify Kaelvi against third-party claims, damages, and reasonable costs resulting from your unlawful use of the Services, your material breach of these Terms, or content you submit that violates another person's rights. This obligation does not apply to the extent a claim was caused by Kaelvi.

14. Events Outside Reasonable Control

We are not responsible for a delay or failure caused by an event outside our reasonable control, including severe weather, natural disaster, carrier or customs disruption, labour interruption, power or network failure, epidemic, war, government action, or supply interruption. We will take reasonable steps to reduce the effect and will provide any cancellation or refund right required by law.

15. Governing Law and Disputes

These Terms are governed by the laws of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Courts located in Quebec will have jurisdiction, unless the mandatory consumer laws of your place of residence give you the right to bring a claim elsewhere or make another law applicable. Nothing in these Terms prevents you from contacting a consumer protection or privacy regulator or using a remedy available by law.

16. Changes

We may update these Terms by posting a revised version and changing the "Last updated" date. Changes apply prospectively from the stated effective date. The Terms in effect when an order was placed continue to govern that order unless a change is required by law or you agree otherwise.

17. General

If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. These Terms and the incorporated policies form the entire agreement concerning the Services, except for any additional written terms presented and accepted for a specific transaction.
